Wedding Contract Terms & Conditions

Photography Coverage and Overtime

The Studio/Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or other emergency. In the event of such substitution, the Studio warrants that the photographer taking the photographs shall be a competent professional.

The Studio/Photographer will begin their coverage at the designated time on this contract. The Photographer(s) will only be required to provide wedding coverage for the specific hours marked on this contract that reflects the wedding package purchased.

It is the client’s responsibility to make sure that any events that they would like to be photographed are completed within the time frame starting from the Photographer’s arrival time marked on this contract. In the event that the timing of the wedding day is interfered with by anything such as make-up/hair, any person involved in the wedding being late or not present to take pictures, or any other cause that arises, the client understands that they will be missing out on key photos that the studio could have taken.

If any of the timing is affected for these reasons or any other reasons, the Studio/Photographer will not be responsible for missed photographs and will not guarantee the number of photographic images as ordered in the Client’s package. The client also understands that the agreed-upon schedule between the studio and client for each aspect of the day is the only time for those certain pictures to be taken.

The Studio or Photographer asks that no other person (professional or amateur) will be taking pictures during our entire coverage. This includes, but is not limited to, other wedding vendors such as wedding coordinators, videographers, and D.J.’s. This interferes with our timing and exposure, and this may affect the outcome of your wedding coverage.

In the event that a person or persons interferes with this clause, a warning will be given to the client. If the problem persists, our coverage will end immediately with no further liability to finish the coverage or deliver the package components, and no type of refund will be offered.

Package Components

The Studio/Photographer takes the utmost care with respect to the timing of receiving your wedding images. While trying to provide this service, the Studio/Photographer requires the cooperation of the client. Please allow ample time for images to be professionally edited and processed, which could take up to eight to sixteen weeks.

The edited high-resolution images will be delivered in an online boutique photo gallery for the client’s personal use only and is not to be used in any other way other than personal printing and preserving. This includes but is not limited to giving files and/or pictures to other wedding vendors, photographers, album design companies, magazines for publication, or using the images for any legal purposes, or any use other than personal printing and preserving without permission from Studio/Photographer.

Studio Liabilities

The studio takes the utmost care with respect to the exposure, development, and delivery of photographs. However, in the event the studio fails to comply with the terms of this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties or due to the Photographer’s illness or emergency, then the Studio/Photographer shall return the retainer fee to the client but shall have no further liability with respect to the Contract.

This limitation on liability shall also apply in the event that photographic materials are damaged in the process, lost through camera malfunction, lost in the mail, stolen, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any reason, the Studio/Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

Model Release/Copyright Notice

The Studio/Photographer reserves the right to use negatives and/or reproductions for the purpose of creating samples, displays for publication in advertising, magazine or newspaper articles, or other public relation purposes. The negatives shall remain the exclusive property of this studio unless otherwise agreed upon by the client and photographer.

It is illegal to copy or reproduce any of the Studio/Photographer’s photographs elsewhere without the express written permission of the Studio/Photographer. Violators of Federal Law will be subject to its civil and criminal penalties.

Booking Information

To reserve your wedding date, a non-refundable Retainer/Booking Fee of ½ down plus a signed wedding contract is required. To reserve the Wedding Date, Client shall pay to Plan-it Ink, upon execution of this Agreement, a non-refundable reservation fee in the amount specified by photographer.

Client understands and agrees that Photographer will not book other sessions during this time. In the event that Client cancels the wedding or fails to attend on the Wedding Date, for any reason, Photographer shall suffer losses that are difficult to ascertain. As such, Client agrees that, in the event of cancellation by Client, such reservation and wedding package fees shall be forfeited by Client and paid to Photographer as liquidated damages and not as a penalty. Client and Photographer agree that such amount is reasonable.

In the event of a postponement, cancellation or date/time change of the wedding, or if the photography services are cancelled for any reason by the client, the Retainer Fee and/or any money received by Plan-it Ink is non-refundable or transferable.

All balances are due 2 weeks prior to the wedding date unless other arrangements have been approved by the photographer. If the remaining balance is not paid in full prior to the wedding date, Plan-it Ink Photography is no longer liable to photograph the wedding and no refund will be given.

Finances

Cash, check, credit, or PayPal is accepted. The charges in this contract are based on the Studio’s current price list. The prices for Wedding extras are not guaranteed unless written into your contract. Any orders placed will be billed at the prices in effect at the time the order is placed.

Please note that we do reserve the right to adjust our prices periodically. All re-orders require a full payment of 100% at the time the order is placed. No part of any order, including previews, will be delivered until the balance is paid in full.

Digital Purchases: High-resolution digital copies of the final images. Client receives a Print Release for personal use only. The owner ("Owner") of the copyrighted photograph or video being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce and distribute the copyrighted Work for personal non-profit purposes, and to incorporate the copyrighted Work, in whole or in part, into derivative works for non-profit distribution. You are prohibited from using the Work for any other purpose, including: using, reproducing or distributing the Work and/or materials incorporating all or any part of the Work for profit; selling or distributing electronic copies of the Work as standalone files or as part of a product from which a person is able to extract the Work as a standalone file; distributing the Work in or as part of an electronic template (e.g., as an image available in a word processing or web page creation application) intended to be reproduced by third parties on electronic or printed products; or using the Work as part of a trademark, service mark or logo. Owner retains all other rights in the Work and any derivative work, including without limitation, the right to use, copy, sell, license, and distribute copies of the Work in all markets and territories. In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work. This Agreement shall be construed and enforced in accordance with the laws designated by Owner, now or in the future.

Professional Reproduction & Prints:
Professional Prints or Canvases may be ordered directly out of your
​online boutique photo gallery for best quality at an extra charge.
Only digital images are included in all packages.

Copyright and Reproductions
Plan-it ink Photography (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.

Facebook Sharing and Other Social Media
It is understandable that the Client might want to post their new photographs on the Internet via Facebook, Twitter, Tumblr, Instagram, and/or any other social media outlets. This agreement will serve to allow posting low-resolution or high-resolution photos to social media sites, only in the case that Plan-it ink Photography is credited and that photos are NOT altered with editing or filters. Additionally, it is understood that the client will NOT remove, or have removed, watermarks from Internet images Plan-it ink Photography has uploaded to Facebook or her website, or from the low-resolution images offered for free to clients who have purchased prints. The Client and family members can purchase photographs that do not have a watermark.
You are permitted to click the “share” button on any photos posted to Plan-it ink Photography's Facebook page. Sharing can NOT be done via screenshots of photos on Facebook or the online gallery.

Edits
Plan-it ink Photography reserves the right to edit and release only the images that are deemed creditable as professional in quality and within Plan-it ink Photography’s standards. The photographer enhances photos via corrections to contrast, lighting, and color, etc. Plan-it ink Photography does not change any inherent qualities of a person, as it is considered a "cosmetic edit" and will be $15 per photo if it is requested by the client. Cosmetic edits include, but are not limited to: removing unwanted hair, adding hair to balding head, changing hair color, changing shape of nose, eyes, body, editing in a person, cropping out a person, removing suntan lines, bruises or acne, removing background images, change color of clothing, etc. 

Failure to Perform
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

COVID WAIVER 1. Client and members of Client’s party assume all risks associated with potential COVID-19 transmission or exposure in relation to the photography services being provided and accept sole responsibility for an illness, injury, damages, claims or expense arising therefrom regardless of the identity of the person alleged to be at fault for such transmission or exposure. 2. As consideration for this waiver, Studio agrees to waive any liability or claim against Client or members of Client’s party for COVID-19 transmission or exposure. 3. Notwithstanding the foregoing, the Waivers contained in Sections 1 and 2 of this Notice and Waiver shall not be interpreted to prohibit actions or claims against persons who knowingly participate in the photography services while exhibiting COVID-19 symptoms or who knowingly participate while having an active COVID-19 infection.
